2. Your Agreement to the Terms.
YOUR ACCESS OR USE OF ANY WEBSITE OR SERVICE IN ANY WAY SIGNIFIES THAT YOU HAVE READ, UNDERSTAND AND AGREE TO BE BOUND BY THE TERMS. By accessing or using any Website or Service you also represent that you have the legal authority to accept the Terms on behalf of yourself and any party you represent in connection with your use of any Website or Service. If you do not agree to the Terms, you are not authorized to use any Website or Service.
3. Changes to the Terms.
From time to time, Refund Express may change, remove, add to (including without limitation by way of Additional Terms) or otherwise modify the Terms, and reserves the right to do so in its discretion. In that case, we will post the updated Master Terms or Additional Terms, as relevant, to the applicable Website(s) and indicate the date of revision. We encourage you to periodically review the Terms. In addition, if our modifications are material, we will make commercially reasonable efforts to notify you electronically. For example, we may send a message to your email address, if we have one on file, or we may display a notice on the Websites indicating that the Terms have changed. All new and/or amended Terms take effect immediately; provided, however, that if deemed material by Refund Express in its sole discretion, such new and/or additional material terms will be marked as such and will take effect 30 days after they are posted on the applicable Website. Notwithstanding the foregoing, (i) no modification to the Terms will apply to any dispute between you and Refund Express that arose prior to the effective date of any modification and (ii) if you do not agree with any modification to the Terms, you may terminate this agreement by ceasing use of the Websites and Services. Your continued use of any Website or Service after new and/or revised Terms are effective indicate that you have read, understood and agreed to those Terms.
4. Application for an Instant Refund (known as a “Rex Instant Refund”).
To apply for a Rex Instant Refund, we advise that the following must be true:
- You are entitled to a refund from the Australian Taxation Office. The estimated refund amount must be larger than the fees outlined by Refund Express for providing the Instant Refund Service.
- You are up to date on all Tax Returns and have no outstanding returns to be submitted to the Australian Taxation Office.
- You have no current debt to the Australian Tax Office or any other government business that may impact your refund. (For example, you owe child support to the Department of Child Support, when lodging your refund, it gets taken from you from this department leaving you with no refund)
- If the above example does happen to you; you will owe Refund Express Australia Pty Ltd the money they have refunded to you or may be ineligible for the Rex Instant Refund process entirely.
You MUST HAVE completed at least TWO years of Australian Tax Returns previously without ATO deductions being made from your refund for any reason.
5. Information Required For Application.
- Current Photo ID i.e. NOT expired.

- Bank Account details i.e. BSB and Account Number.
6. Instant Refund Transfer.
If you are eligible for an Rex Instant Refund we will transfer the refund to your designated bank account by EFT (this is the only transfer type supported. Cash or cheque payments are unavailable), this process can take up to an hour or twenty-four hours depending on which bank you are with. Any submissions out of business hours will be dealt with the next business day. Refund Express do not have any control over the length of time it will take your bank or financial institution to deposit the instant refund amount into your nominated account.
Any information not provided willingly or unwillingly during the application process by the client that results in the application being at a reduced amount, or invalidating the application lies solely with the client.
Refund express during the instant refund process may need to take extra time to verify information, or retrieve information from your ATO portal account. This may increase the time taken in the original submission process with the need to engage in any of these verification’s and checks. The term ‘Instant’ refers to a shorter time period (ie: as soon as all information is verified and correct) needed to transfer funds to an individual on completion of a return submission, and not the submission process itself.
Your Rex Instant Refund will be funded by Refund Express Australia Pty Ltd and will be paid back when your refund from the Australian Taxation Office transfers it to Refund Express Australia Pty Ltd trust account. Only the Rex Instant Refund amount and fees for using our service will be taken from the whole refund given by the Australian Taxation Office, the remainder will be transferred to your designated bank account. Refund Express is not responsible for any delays on refund processing relating to any ATO based requirements (eg: auditing, general processing delay). When the final refund is processed from the ATO, the amount received will be claimed by Refund Express to cover the loaned amount provided to the client in the instant refund process.
In the event where your overdue account is referred to a collection agency and/or law firm, you will be liable for all costs which would be incurred as if the debt is collected in full, including legal demand costs. Overdue accounts will be subject to interest at the rate equal to the ATO’s quarterly FBT rate, calculated for the period the account is due until the date it is paid
8. Do not call register – Consent.
For the purposes of the Do Not Call Register Act 2006 (if it applies) – by submitting your contact details or your telephone number. Your consent expressed or deemed consent to be contacted by Refund Express Australia Pty Ltd and affiliated company. You consent to be contacted by phone, email, mail or sms.
9. Additional Conditions.
Please note that reference to ‘The client’ in these terms and conditions refers to the person using this website and is the person linked directly to the Tax File number on this site.
Personal information about visitors to our site is collected only when knowingly and voluntarily submitted. For example, we may need to collect such information to provide you with further services or forward any request or enquiries onto third parties. It is our intention that this policy will protect your personal information from being dealt with in any way that is consistent with applicable privacy laws in Australia.
Disclosure is made under Section 18(E)(8)© of the Privacy Act 1988, that certain items of personal information contained in the Agreement and kept on a credit file, may be disclosed to a CRA and used for the purpose of assessing the client’s credit worthiness or if the refund remains unpaid to Refund Express Australia Pty Ltd.
Due to the possible risk to both parties in an instant refund transaction, Refund Express reserve the refuse or reject a submission based on either a calculated risk profile, or the possibility of unknown information interfering with the process based on the clients current profile, past account history, or undisclosed reasoning.
